Periodically, each employee has the right to have the annual leave within the limit of the number of days/year allowed by the legislation, but also by the subsequent negotiations with the employer, in such a way that the legal provision is not circumvented.
However, in addition to vacation days, employees also benefit from days off related to public holidays. Specifically, these public holidays are days off, in which the employees don’t work. These are established in the Labor Code and will be granted by the employer.
What are the public holidays on which there is no work for employees?
15 days of public holidays are regulated, as follows:
- 1st & 2nd January – The first days after New Year’s Eve
- 24th January – Day of the Romanian Principalities
- Big Friday, the last Friday before Easter
- The first and second day of Easter
- May 1 – Labor Day
- June 1 – International Children’s Day
- The first and second day of Rusalii – Descent of the Holy Spirit
- Assumption of the Virgin Mary
- November 30 – Saint Andrew the Apostle, the First Called, the Protector of Romania
- December 1 – Romania’s National Day
- The first and second day of Christmas
However, what must be emphasized is the fact that these days are established in relation to the Christian religion, and in the case of other legal religious cults, it will be considered to grant 2 days for Easter, Rusalii and Christmas in the related period on days other than those of legal holiday according to the law and those of annual rest leave.
What if the first and second days of Christmas fall on the weekend?
Unfortunately, if they don’t have two other working days as their correspondent, in principle, they will not be able to be granted within them. If the first day of Christmas is Saturday, and the second day of Christmas is Sunday, Monday will be a working day.
But there are also companies that allow employees to take a day off during the week for a maximum of 30 days, for example.
Is the employee of a religion other than Christian and still get the same day off?
In the event that an employee is not a Christian, but receives a day off for Easter, although he celebrates it in a different period, they will recover those additional days according to a schedule established by mutual agreement with the employer.
Basically, they will be treated fairly by getting those days back.
Does it apply to all employees?
In principle, yes, but there are exceptions. For example, if we are talking about people who have a job whose specific activity doesn’t allow interruption, the provisions regarding public holidays won’t apply.
At the same time, a working schedule will be established for the sanitary and catering units on public holidays, but with the obligation of the employer to compensate with appropriate free time in the next 30 days.
Can other days off be granted?
Of course, other days off can also be established at the level of the collective labor agreement.
