How can a Romanian immigration lawyer help you?

If you are facing challenges related to immigration to Romania, the support of an attorney specialized in immigration law can make a significant difference. In a process that often seems complicated and filled with legal formalities, a lawyer can provide the necessary legal advice, ensuring that all documents are filled in correctly and all legal deadlines are met.

From obtaining a Schengen visa and Romanian residency, to handling court appeals or resolving issues related to your legal status, an immigration lawyer can be your essential partner in achieve your goals.

Initial legal consultation

In the field of immigration, this type of consultation is essential, as the legal procedure involves numerous aspects that must be considered from the very beginning. Whether it concerns acquiring Romanian citizenship, a residence permit, or a visa, the specialized lawyer will carefully analyze your current situation.

An essential first step is understanding your status regarding citizenship and available documents, for example:

  • If you want to apply for Romanian citizenship based on descent from Romanian parents or grandparents, there must be clear evidence of the blood relationship. If such evidence is missing, the lawyer will guide you in obtaining it.
  • Additionally, if you plan to reunite with your family in Romania, we will also assess the citizenship status of your family members, as this may influence the immigration procedures.

In many cases, to properly prepare your case, the lawyer will request scanned copies of relevant documents to verify all necessary information. If you lack clear evidence of your descent or other useful documents, the lawyer will work with you to identify the steps required to obtain them.

Furthermore, depending on your needs, a price quote will be provided for the services offered, based on a comprehensive evaluation of your situation. The cost of services varies depending on the documents you hold, the type of citizenship you wish to obtain, and the complexity of the case.

Currently, our office offers paid initial legal consults, either through a video call or at our office in Bucharest. This ensures that we can thoroughly assess each case and determine eligibility, avoiding situations where clients might attempt to handle issues on their own.

If the client has a justified case and decides to continue working with us, the fee for the initial consultation will be deducted from the next invoice, so our initial consult is basically free.

Preparation of the necessary immigration file

Additionally, your lawyer provides complete assistance in preparing your immigration file.

For example, if you got a job in Romania and wish to apply for residence, not only will we prepare the necessary documents, but we can also accompany you in person to the General Inspectorate for Immigration (IGI). Furthermore, we can pick up the residence permit once it is issued.

In cases where the client is not residing in Bucharest, the legal consultation is provided via email or phone to identify their needs, followed by the establishment of a fee.

Upon accepting the quote and paying a retainer, we can receive and check the necessary documents by email. The only difference is that the lawyer will not physically accompany the client to IGI, but will remain available for any questions and support, ensuring a comprehensive and efficient service.

What we cannot help you with as immigration lawyers

In the field of immigration, lawyers can offer a wide range of services, but there are also certain legal limitations to their scope. It is important for each client to understand the lawyer’s area of expertise in order to have clear expectations and avoid confusion.

Therefore, it is important to note that the lawyer cannot apply for residence on behalf of the client, for example, through a power of attorney, because this process requires the applicant to live in Romania. Simply attaching a photo of the client to the immigration file is not possible.

Additionally, your lawyer will not accept only drafting the documents for the client to submit the file independently, as this could lead to delays or issues. The lawyer must handle the entire process—preparing and submitting the documents—or the client chooses to manage it on their own.

Furthermore, another aspect that your lawyer can not perform is simply scheduling the immigration file on the online platform of the General Inspectorate for Immigration (IGI), without being further involved in the file. Although documents can be submitted online, the immigration officer will want to see the client in person, and the meeting is mandatory.

However, your lawyer will assist in preparing the file, will accompany the client to IGI, and can provide remote assistance, having access to the online platform of the authorities.

Moreover, your lawyer cannot simply accept the documents prepared by the client, without checking them further, because there is a risk that they may not be properly completed, which could result in an incomplete or incorrect file. In such a case, the lawyer would be responsible for that file. To avoid such issues and reduce costs, this type of assistance cannot be provided.
